Legarda brings veteran experience to Duterte impeachment trial

Senator Loren Legarda, a four‑term lawmaker, is once again serving as senator‑judge in the impeachment trial of Vice President Sara Duterte.

Legarda is one of only two senators with experience in three impeachment trials, having taken part in the proceedings against President Joseph Estrada from November 2000 to January 2001, Chief Justice Renato Corona from December 2011 to May 2012, and Vice President Sara Duterte in July 2025. Her continuity of experience offers valuable perspective in a chamber where many senators are confronting the demands of the impeachment process for the first time.

“Preparing for impeachment is not merely a legal exercise. It is a test of judgment, conscience, and institutional duty. I have seen how impeachment trials test the strength of our institutions and the resolve of those who serve. The process must rise above political factions and personal attacks, and focus only on the evidence, the Constitution, and whether the alleged acts warrant conviction,” Legarda said.

During the July 6 deliberations, Legarda manifested that the question of who presides over the impeachment court must be resolved with fidelity to the intent of the framers of the 1987 Constitution. She cautioned that any departure from the traditional arrangement could place the validity and legitimacy of the trial in doubt, stressing that constitutional design should guide the Senate in exercising its solemn duty.

She also placed on record that there is a pending challenge before the Supreme Court involving the June 3 Senate proceedings and Senate Resolution No. 430, including questions on the authority of the body that adopted it. Legarda clarified that her position in the impeachment court is without prejudice to the final determination of the Supreme Court, affirming that she is not waiving any of her arguments in the case now under judicial review.

Legarda’s veteran role highlights the importance of seasoned voices in guiding the Senate through the complexities of its constitutional duty.

The impeachment court will hold sessions until July 22, before resuming on July 28 onwards. Legarda’s presence is expected to help ensure that the proceedings are marked by fairness, discipline, and respect for the rule of law. (30)

Nagsisilbing senator‑judge si Senadora Loren Legarda, apat na termino nang mambabatas, sa impeachment trial ni Vice President Sara Duterte, dala ang kanyang karanasan mula sa mga nakaraang paglilitis.

Isa siya sa dalawang senador na nakaranas ng tatlong impeachment trial: kay Pangulong Joseph Estrada mula Nobyembre 2000 hanggang Enero 2001, kay Punong Mahistrado Renato Corona mula Disyembre 2011 hanggang Mayo 2012, at sa paglilitis laban kay Vice President Sara Duterte noong Hulyo 2025. Nagdadala ang kanyang karanasan ng dagdag na pananaw para sa mga kasapi ng kapulungan na unang beses humaharap sa proseso ng impeachment.

“Ang paghahanda para sa impeachment ay hindi lamang gawaing legal. Isa itong pagsubok ng paghatol, konsensya, at tungkulin ng institusyon. Nasaksihan ko kung paanong sinusubok ng mga impeachment trial ang tibay ng ating mga institusyon at ang paninindigan ng mga naglilingkod. Dapat itong umangat sa itaas ng mga hidwaang pampulitika at tumuon lamang sa ebidensya, sa Konstitusyon, at kung ang mga akusasyon ay may batayan para sa pagkakakondena,” ani Legarda.

Sa deliberasyon noong Hulyo 6, iginiit ni Legarda na ang usapin kung sino ang Presiding Officer ng impeachment court ay dapat resolbahin nang tapat sa layunin ng mga bumalangkas ng 1987 Konstitusyon. Binalaan niya na ang anumang paglayo sa nakasanayang kaayusan ay maaaring magdulot ng pagdududa sa bisa at lehitimidad ng paglilitis, binigyang‑diin na ang disenyo ng Konstitusyon ang dapat gumabay sa Senado sa pagtupad ng kanyang tungkulin.

Itinala rin niya na may nakabinbing usapin sa Korte Suprema kaugnay ng mga naganap na proseso sa Senado noong Hunyo 3 at sa Senate Resolution No. 430, kabilang ang mga tanong sa awtoridad ng kapulungang nagpasa nito. Nilinaw ni Legarda na ang kanyang posisyon sa impeachment court ay walang pagwawaksi sa magiging pasya ng Korte Suprema, at pinagtibay na nananatili ang lahat ng kanyang argumento sa kasong kasalukuyang nasa pagsusuri ng hudikatura.

Ang kanyang papel bilang beterano sa impeachment proceedings ay nagpapakita ng kahalagahan ng mga may karanasan sa paggabay sa Senado sa gitna ng tungkulin nito sa ilalim ng Konstitusyon.

Magpapatuloy ang mga sesyon ng impeachment court hanggang Hulyo 22, bago muling ipagpatuloy sa Hulyo 28. Inaasahang ang presensya ni Legarda ay makatutulong upang masiguro na ang mga pagdinig ay may tanda ng patas na proseso, disiplina, at paggalang sa batas. (30)
